Legal discovery is the process of inquiry in a civil lawsuit by way of depositions, interrogatories and request for documents. Legal discovery of electronically stored information (ESI) is e-discovery. Electronically stored information includes but is not limited to emails, web pages, spreadsheets, computer databases, backup tapes, cache memory etc.
In 1970 the FRCP was amended to include "data compilations" within the purview of legal discovery. With the growth of electronic communication, the scope of electronic data increased substantially. Hence on December 1, 2006, FRCP was again amended to include ESI as a distinct category. The ESI in a single case can be terabytes of data.
